Claim for illegal detention of 19 geese. Mr Burton for plaintiff. Defendant admitted possession of the birds, but pleaded that they had been destroying and eating his oats.
Order for the property to be returned within 48 hours, and 2s 6d costs.

Sergeant Archibald submitted that this house (was not up to standard), both inside and outside. It was just opposite of Witcombe's Back Creek Hotel.
The Bench refused the application, and told applicant that after he had altered the character of the house he could apply again.

Amos SHOEMACK was brought up charged with having stolen a saddle, the property of Geo. REDMAN, Sulky Gully.
Sergeant ARCHIBALD swore that from information received he arrested the prisoner on the above charge. Prisoner had then stated that he bought the saddle from a man who told him that he had lost his horse and had no use for a saddle.
Remanded till Friday, bail allowed - self £100 and two sureties of £50 each.

Amos SHOEMACK surrendered to his bail charged with having stolen a saddle. Mr TRENCH appeared for the prisoner.
George REDMAN, hotelkeeper, Sulky Gully, sworn - Remember the morning of the 13th November. Missed my saddle from the stable and gave information to the police. On Saturday Frank O'DONALD brought the saddle to me, he was in company with prisoner and another man, and he said he had bought it from the prisoner for £4. I marked it in the prisoner's presence. [Saddle produced in court.] I value it at £6 and identify it by a mark No. 4. The old man said he could get the man of whom the saddle was bought within two hours.
To Mr TRENCH - I could not swear that prisoner stole the saddle. Met prisoner at the Bald Hills, gave him a general description of the saddle; he said he would get it for me. BAILEY was the name mentioned. Prisoner told me to keep the saddle and asked permission to put a mark on it.
To the Bench - Saw the saddle last on the 12th November. Am not aware that the prisoner was on my premises on that day or on the 13th. The saddle was taken from the old stable, which was unlocked; people can approach it from the bush.
Sergeant ARCHIBALD stated he had made inquiries at Inglewood about the man BAILEY alluded to, who was supposed to live on the Jersey Reef. He had just received the answer per telegraph that the man was not known there.
James CARROLL, miner, Bald Hills, sworn - Do not know a man BAILEY. Did not say that I would produce him in two hours. Have been working in the Great Eastern, Bald Hills, for ten months. Frank O'DONALD is in court.
Mr TRENCH addressed the Court for the defence and stated in addition that respectable persons who had known the prisoner for the last nine years were willing to come forward to give him a good character.
The Chairman, after a consultation with his brother magistrates, intimated that the Bench did not consider the evidence sufficient to commit the prisoner for trial and he was discharged.
The Court then adjourned for ten minutes.
